| On October 30th 2009, a change in voting rights was notified to KTM Power Sports AG. |

The CROSS Industries AG, Edisonstrasse 1, 4600 Wels, controlled by Stefan Pierer and Rudolf Knünz, who themselves are the respective sole shareholders and managing directors of the Pierer GmbH and the Knünz GmbH, notifies the conclusion of contracts with the three members of the Executive Board of KTM Power Sports AG, Patrick Prügger, Hubert Trunkenpolz and Harald Plöckinger respectively, binding their voting rights to CROSS Industries AG. Thereafter such voting rights of these Executive Board members in the amount of 127,500 shares, which corresponds to 1.68% of the total voting rights and shares in the capital stock of KTM Power Sports AG, will be exercised consistently with CROSS Industries AGs voting rights.
As of October 30th 2009, a number of 127,500 shares of KTM Power Sports AG will have to be attributed to CROSS Industries AG.
As of October 30th 2009, CROSS Industries AG holds around 50.19% of the voting rights of KTM Power Sports AG (3,804,033 shares) and has crossed the 50% threshold.
Subsequently as of October 30th 2009 also the KTM Power Sports AG voting rights of the Pierer GmbH and the Knünz GmbH, which were indirectly exercised via the CROSS Industries AG, as well as the KTM Power Sports AG voting rights of Stefan Pierer and Rudolf Knünz, which were indirectly exercised via the Pierer GmbH, the Knünz GmbH and the CROSS Industries AG, have crossed the 50% threshold by attributing another 127,500 shares (number of voting rights: around 50.19%; 3,804,033 shares).
